ATT customer William Gillis was unhappy with the performance of his shiny new Iphone 3G so he filed a lawsuit. The lawsuit doesn't just focus on the performance of the phone, but also that ATT and Apple consciously oversold the Iphone.
He claims that the handset that requires "too much power" combined with the saturation of Iphones that have been sold, bombarded the network so much that it would only allow users to connect to EDGE 2G networks while dropping all the 3G calls, even though 3G coverage was guaranteed.
Gillis also points out that none of Apples packaging warns buyers of the current Iphone performance issues, and asks that they evaluate their product before marketing it to the public.

While I'm not particularily happy with its performance either, I'm not going to cry and file a lawsuit. Remember Blizzcon? I'm not even filing a lawsuit for that, nor would I ever. Sometimes there is just no way to comprehend just how popular a product is going to be, and even if you had and made preparations, people will still complain that what you did wasn't good enough.
